Dear Sudhakarji,

Thanks for posting update on Narayanpatna issue. The state sponsored violance,crime and atrocity on tribal people is really embrassing. One can image, it is happening in so called 5th Scheduled Area /PESA area where it is excepted that there would be self governance of tribal people! No word is suffcient to condemn state's role in suppressing democrating struggle of tribal community. I am really wondering whether the exiting law / constitutional provisions including PESA and SC-ST (Prevention of Atrocity) Act-1989 are of any use!!! The SC-ST (Prevention of Atrocity) Act has completed 20 years but found to be complete useless and toothless. What about role of Governor to protect interest of 5th schedule area?? As per  the constitutional provision "The Governor may make regulations for the peace and good government of any area in a State which is for the time being a Scheduled Area. In particular and without prejudice to the generality of the foregoing power, such regulations may- (a)prohibit or restrict the transfer of land by or among members of the Scheduled Tribes in such area; (b)regulate the allotment of land to members of the Scheduled Tribes in such area; (c)regulate the carrying on of business as money-lender by persons who lend money to members of the Scheduled Tribes in such area." The state and corporate violance in tribal regions is mounting day by day...but there is no intervention of Governor in  this regard.

The issue of Narayanpatna is tip of the iceberg as tribal community all over the country have been the worst victim of all such brutality and repression. If state is failed to provide basic minimum needs of people and ensure their inalienable rights.... it has no right to behave in  such a uncivilised way.

*Who will protect the tribals of Narayanapatna?* The Chasi Mulia Adivasi Sangh (CMAS) leading the tribal agitation to lead the lives free from the clutches of money lenders, land grabbing non-tribals, liquor (vendors belonging to a particular community), corrupt politician, equally corrupt bureaucrats. The agitation almost turning into a peace after visiting the village Bhaliaput by series of peaceful committees. The paternal land of the tribals when failed to get back though a democratic process got the land through mass movement. Here the question of the leader is leadership doesn't arise. However quiet surprisingly the government declared Nachika Linga as "most wanted person" which recollects no other than British raaj before independence. This it most probably would remind in the history like another leader Mr. Laxman Nayak who was sent to gallows couple of year before independence. I never had jurrying a leader who was fighting for the right to live in a society not allowed to provide the right to live not only to him but also to his community. I don't know whether it is a democracy or demon cracy. The armed constabulary deployed in Narayanapatna doesn't know the language which the tribal dialects speak not even Oriya who are hunting the tribals in Narayanapatna turned a hunting ground backed by bureaucrats. the politicians sitting at New Delhi or at Bhubaneswar dictating the terms to his armed constabulary most probably to eliminate in the name of peace. This is what actually happens several times even before independence. Around 64 persons including children taken to police custody and confined them in jail. The cases initiated against them attract life imprisonment or hang to death. It is practically not possible on the part of the lawyers to bail them out within months. The armed constabularies are now the part of the state terrorism looting and destroying the belongings of the tribals even which includes chickens, goats and other tribal foods which is essential throughout the year. PDS system completely failed schools remained closed the school going children with their old and young family members inside the jungle out of fear under the severe cold. The land seized by the tribals from the non-tribals cultivated and expected bumper crop first time this year by using organic fertilizer. When they are about to harvest the paddy the police calculatedly killed the tribal leader M.Singanna and two others (one body under mystery) and followed systematically depressing the tribals. Is it not the duty of the sub-collector who is claiming himself a member of poor farmer's family to look out the other farmers (tribals) those who are starving without food? In fact the tribals raised healthy crops successfully on 2000 acres but after the killing of the leaders on 20.11.09 the fields are still waiting of harvesting. In the meantime the state influences the CMAS to share the crops between the tribals and non-tribals which are UN constituonal and bad principles. The cruel administration and the hiding attacks spoiled the farming infrastructures of the tribal at Narayanapatna which leads one again slavery after 64 years of independence. Now the activists are prevented to enter in Narayanapatna, independent press is not allowed to enter even if they entered their movements are being watched by the plain dressed police officials.* Except local press and electronic media representatives who are also part and partials of the tribal land grabbers.* We don't understand whether the Koraput district is manned by district administration or police officials. The press even not allowed meeting the UTPs of Narayanapatna in Koraput jail even after obtaining the permission from the District Magistrate who is competent authority to permit to meet the UTPs inside jail as per the jail manual. Dear all, Pranam ! Sham of democracy has again shamed the state of Orissa (Odisha). Ironically, the treasury bench has found that the Assembly of the state has nothing serious to discuss and has decided to abruptly terminate the Assembly session a full 13 days ahead of its schedule. When the state is gripped with the beginning of a farmer suicide syndrome, when a gigantic mining scam is slowly unearthing, when land settlement issues in disputed territories are becoming increasingly undemocratic... the government found nothing serious to discuss. This kind of shamelessness on the part of the government to prorogue the Assembly so abruptly and so ahead of its scheduled session is highly disgusting and deplorable. Government side argues that this is not new and such instances have happened in the past. Such arguments are not untrue and the Assembly has been terminated ahead of its schedule in few cases. We can immediately recall to the incidence of premature closure of the session after the opposition stalled proceedings consecutively for days in the aftermath of lathicharge on the agitating farmers in Burla over Hirakud reservoir water diversion. While proroguing/terminating after serious disruptions of proceedings or genuine absence of issues can be justified somehow, the situation was not such this time. Plethora of serious issues are there to be discussed. But the government's eyes are closed to those and hence it is not able to see such issues. But even this may not be true. The government is deliberately trying to gloss over the issues. And it is adopting all kind of undemocratic means to achieve its objectives. While the government has shown its intolerance to opposition in the past, with this incidence, a new chapter in its heinous governance has been added. The government has lost all democratic credentials and has just become a 'byapari'. And god knows what will be the fate of the state. Our ancient literatures say, 'Jahin Raja Byapari... Tahin Praja Bhikari'. It is nothing but a clear case to avoid critical but uneasy (for the government) discussions and debates. The CSOs must rise to deplore this incidence with the strongest of language. This kind of disgraceful treatment of democracy is a peril to the society. With regards Bimal Prasad Pandia 9438488563
